Terms of Service

These terms explain how Merrimack Mushroom Co. harvest drops, reservations, payments, pickup, local delivery, cancellations, and refunds work.

1. Our business and these terms

Merrimack Mushroom Co. ("Merrimack Mushroom," "we," "us," or "our") grows and sells fresh culinary mushrooms through limited harvest drops in New Hampshire. By placing an order through this site, you agree to these terms and our Privacy Policy.

2. Products and harvest drops

We sell cultivated, fresh culinary mushrooms in limited, non-recurring drops. Species, pack size, quantity, price, pickup window, and delivery availability can change from one drop to the next. The details shown for the active drop at the time you reserve are the details for that order.

Harvests depend on growing conditions. An item can sell out while you are ordering, and we may need to cancel or adjust an order if a crop, inventory, safety, or fulfillment problem prevents us from supplying it. We will contact you and refund any amount charged for an item we cannot provide.

3. Orders, prices, and payment

  • All prices and charges are in U.S. dollars (USD).
  • Orders are one-time purchases. We do not enroll customers in subscriptions or automatic renewals.
  • Every paid order must have a positive total; complimentary and zero-dollar orders are not accepted.
  • Your item subtotal, delivery fee, tax, and total are shown before you submit payment.
  • Available card and device-wallet methods are the methods Stripe displays for your device and order. When cash at pickup is offered, it appears separately in the reservation flow.

Starting Checkout does not by itself confirm an order. Card inventory is held for a limited time and the order becomes paid only after Stripe confirms payment. An unpaid or expired Checkout can release the hold. Stripe processes card credentials; Merrimack Mushroom receives transaction and payment-status information needed to fulfill and reconcile the order, not your complete card number or security code.

4. Pickup and local delivery

Farm pickup

Pickup is free. The available window and pickup instructions are provided with the drop and order confirmation. Please contact us if you cannot arrive during the stated window.

Local delivery

Delivery is available only for eligible New Hampshire addresses within the active delivery area. We calculate the delivery fee from the address and show the exact fee before payment. You are responsible for providing a complete, accurate, accessible delivery address and a safe place to leave the order if you will not be present.

Delivery timing can be affected by weather, road conditions, harvest timing, or other safety issues. We will communicate material changes using the contact information on the order.

5. Tax

Under our current New Hampshire raw-food policy, we collect $0.00 in sales tax on these raw mushroom orders and Stripe automatic tax is not used. If the product, fulfillment area, or applicable law changes, any required tax will be disclosed before payment.

6. Cancellations, returns, and refunds

Mushrooms are fresh and perishable, so we do not accept routine returns after pickup or delivery. Do not ship or bring food back unless we ask you to. This policy does not limit rights that cannot legally be limited.

  • To request a cancellation, contact us as soon as possible and before the pickup or delivery window. Approval is not guaranteed once harvesting, packing, or delivery work has begun.
  • For a missing, incorrect, damaged, or quality-concern order, contact us promptly with the order code, a description, and photos when useful.
  • We review each request individually and may offer a replacement, credit, partial refund, full refund, or no refund based on the facts and applicable law.
  • Approved card refunds go back to the original payment method. Your bank or card issuer controls how long the credit takes to appear after Stripe processes it.

Start a request on the Customer Support page. A payment dispute is not a substitute for contacting us, but nothing in these terms limits any rights you have under applicable law or your card agreement.

7. Fresh-food care and use

Inspect mushrooms when you receive them, refrigerate them promptly in breathable packaging, and cook them thoroughly before eating. Do not eat a product that appears spoiled or that you cannot confidently identify from its label. Mushrooms are sold as food, not as a medical product, and individual allergies or sensitivities can occur.

8. Receipts and communications

We use the email address and, when provided, phone number on your order for receipts and operational updates such as pickup, delivery, cancellation, or refund status. Marketing email and SMS consent are separate from purchasing. You can unsubscribe from marketing email using its link or reply STOP to a harvest-drop text; essential order messages may still be sent when needed to complete your order.

9. Website and account use

Provide accurate information and keep account access links private. Do not interfere with the site, attempt unauthorized access, test stolen payment credentials, misuse limited inventory, or use the service unlawfully. We may reject or cancel activity reasonably associated with fraud, abuse, or a safety risk and will handle any resulting charge according to applicable law.

We work to keep the site accurate and available, but harvest information and online services can occasionally be delayed or interrupted. To the extent permitted by law, Merrimack Mushroom is not liable for indirect or consequential losses arising from use of the site. Nothing here excludes liability or consumer rights that cannot be excluded under applicable law.

10. Changes and governing law

We may update these terms as the service changes. The effective date above identifies the current version; changes apply prospectively when posted unless law requires otherwise. These terms are governed by New Hampshire law, without overriding consumer protections that apply to you.
